Fr&uuml;her als reine Gefahrenabwehr begriffen, wird der Schutz vor Naturgefahren mittlerweile als in sich geschlossener Kreislauf von Vorbeugung, Bew&auml;ltigung und Regeneration verstanden. Im Vordergrund steht die Naturgefahrenpr&auml;vention. Dabei handelt es sich einerseits um eine ausgesprochene Querschnittsmaterie und andererseits um eine Verbundaufgabe. Der Vollzug der Naturgefahrenpr&auml;vention obliegt zu weiten Teilen den Kantonen.<\/span><br \/><span>Infolgedessen fokussiert die vorliegende Arbeit einerseits auf das kantonale Organisationsrecht im Bereich der Naturgefahrenpr&auml;vention, das &uuml;beraus heterogen ist. Von Interesse sind insbesondere die kantonalen Organisationsstrukturen. Anhand eines Rechtsvergleichs wird eine &Uuml;bersicht &uuml;ber die Organisation und die Zust&auml;ndigkeiten gegeben. Es werden sowohl die horizontalen (Verh&auml;ltnis Kanton) als auch die vertikalen Organisationsstrukturen (Verh&auml;ltnis Kanton-Gemeinden-Private) beleuchtet. Die einzelnen Organisationsmodelle werden miteinander verglichen und anhand von anerkannten organisationsrechtlichen Grunds&auml;tzen (z.B. Subsidiarit&auml;tsprinzip, Gemeindeautonomie etc.) gew&uuml;rdigt. Andererseits werden die Verfahren, in welche die Massnahmen der Naturgefahrenpr&auml;vention eingebettet sind, n&auml;her beleuchtet. Es werden prim&auml;r jene kantonalen Verfahrensvorschriften analysiert, welche der Koordination der verschiedenen Massnahmen der unterschiedlicher Aufgabentr&auml;ger dienen.&nbsp;<\/span><br \/><span>Mit der vorliegenden Arbeit soll ein Beitrag an die bislang kaum existente rechtswissenschaftliche Erfassung des kantonalen Organisations- und Verfahrensrechts im Bereich Naturgefahrenpr&auml;vention geleistet werden.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Die wachsende Bedrohung durch Naturgefahren hat den Fokus auf einen sachgerechten Schutz vor Naturgefahren wesentlich verst&auml;rkt.
